Terms Applicable to Sale of Goods

These terms apply where you wish to purchase goods from Etre Limited (registered number 4552495 ("Etre") by electronic means.

Availability of Products

In these terms and conditions, when we refer to "products" we mean any of the goods sold or made available through this Web Site.

We do not warrant or represent that any product featured on the Web Site will be available at the time you place an order. Availability may vary depending upon the nature of the product chosen.

All information available on our Web Site in respect of our products constitutes an invitation to treat and not an offer by us to be bound to supply those products. An offer will only arise in the circumstances set out below (see "How is a contract made with Etre?").

In certain circumstances we may offer you the ability to purchase certain of our products before they become generally available to the public. We call this process pre-ordering. In these circumstances you understand that the relevant products will not be available at the time your order is placed, but will be available at a later date. We will identify in advance those products which may be pre-purchased and we will inform you prior to placing the order of the time we estimate prior to us receiving and dispatching the pre-ordered products to you.

How Is A Contract Made With Etre

When you submit an order to purchase one of the products featured on our Web Site, we will send you an e-mail confirming the details of your order. Should any of these details be incorrect, you should let us know by phone, e-mail or telephone immediately. If the details are correct, you need do nothing further.

Your submission to Etre constitutes an offer to Etre to purchase the goods which may be accepted by us. Acceptance of your offer will occur upon Etre sending to you an e-mail confirming that Etre has sent the relevant product to you.

Languages Available For Conclusion Of The Contract

English is the only language available for you to place your order with Etre.

Unavailability

If the goods you have ordered from us are not available, we will contact you by e-mail to advise you of such. In our e-mail we will offer you the option to place your order on back-order for fulfilment when the relevant products are available (so long as we intend to replenish our stock of the relevant product in question), or to cancel your order without penalty.

Cancellation Rights

Customers within the European Union are entitled to a cooling-off period of seven (7) business days (beginning on the day after the day on which you receive the goods) during which you may cancel the contract made with Etre. Should you wish to exercise this right, you must, (a) within the time period above, give written notice (by e-mail, fax or letter) to Etre indicating your intention to cancel the contract; and (b) return the goods already delivered to you at your cost.

In the event that you choose to cancel your agreement with us we will issue you with a refund once we have received the goods originally delivered to you. We strongly recommend that you only send such goods by recorded delivery for your own protection.

Etre may, in its absolute discretion and depending upon the facts of a particular case, extend the right to cancel to customers outside the European Union.

Gift Vouchers and Discount Codes

Etre Touchy gift vouchers and discount codes are non-refundable and have no cash value. Etre Touchy gift vouchers and discount codes are redeemable online at www.etretouchy.com only.

When using an Etre Touchy gift voucher or a discount code to make a purchase on this Web Site, no change or credit will be given where the value of the gift voucher or discount code used exceeds the value of the order. If the order value exceeds the amount of the gift voucher or discount code, the balance must be paid by one of our other available payment methods. Only one gift voucher or discount code can be redeemed against an order.

Etre disclaims all responsibility for any lost gift vouchers or discount codes.

Children

Please note that Etre does not sell to minors. If you are under 18 and wish to purchase one of our products, you may only do so with the involvement of your parent or guardian.

Liability

Etre will not be liable for any indirect or consequential losses resulting from our breach of contract. We will also not be liable for any loss of profit you may incur as a result of our non-performance. Etre's maximum liability in the event it breaches a contract concluded with you (or is otherwise negligent, acts in breach of trust or in breach of statutory duty) shall be limited to the value of goods ordered.

Nothing in these Terms is intended to exclude Etre's liability for fraud, personal injury caused by the negligence of its employees or anything else that cannot be excluded by operation of law.

Miscellaneous

Etre shall have no liability for any breach of contract caused by circumstances beyond its reasonable control.

A person who is not a party to any contract made shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms.

Governing Law

Any contract made between Etre and you will be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English and Welsh courts.
